What You're Buying

When you commission a song from MusAIc by ~MAK, you are purchasing a personal-use license to a custom AI-generated musical work. You are not purchasing copyright ownership. Under current U.S. copyright law, AI-generated works cannot receive copyright registration.

Personal-Use License

Your license grants you the right to: play the song at private events (weddings, memorials, parties, gatherings), share the song with friends and family, keep the song permanently for personal enjoyment, and use the song in personal (non-commercial) video projects.

Commercial License

Commercial licenses are available for business, brand, and performance use. These are scoped per project and quoted individually. A commercial license grants the right to use the song in commercial settings including advertising, public performance, branded content, and event production.

Selling Your Song — Revenue Share

These are the terms in advance rather than after you have committed. Selling requires your written consent first — nothing goes on sale without it — and a separate seller agreement is signed before anything is listed.

Fees and the split cover different things. Your commission pays for the song being written and made, and for keeping it in your life permanently. Out in the world pays for the work of getting it out correctly and for it stopping being private — mastering, artwork, metadata, the per-service AI disclosure, delivery to the platforms, the store here, and the splits set up. The split is not a second charge for any of that. It is the record itself once it becomes something that earns, it is even because we made that record together, and it is agreed before a word of it is written rather than bolted on when the money shows up.

If MusAIc wrote the song — the words, the arrangement, the production, the master — revenue is split fifty-fifty. That is half of what actually lands, after the card processor or the streaming service takes its cut; we absorb the same fees you do. It applies to every channel: a download sold here, a stream anywhere, whatever the record earns. Paid monthly, within 15 days of month end, with a $25 minimum that rolls forward. On a record we made, we hold nothing back against what might go wrong later — no reserve, no holdback. We carry that risk ourselves.

There is one thing a sale can do after the fact, and you should know it before you see it on a statement. A buyer can ask their card company to reverse a purchase for up to 120 days after they make it, sometimes longer, and that decision is the card network's rather than ours. If a sale is refunded or reversed after you have already been paid for it, that amount comes off your next payout. We are not holding money back to cover it — we carry it — but we do not pay for the same sale twice.

You agree to this at the order, not here. There is a line on the payment step saying the split in one sentence, and the order will not go through until you tick it — so nobody discovers this after the fact. What you ticked is kept, word for word as it read that day, against your commission. Memorials are never asked, because nothing from a memorial is ever released and there is nothing for it to apply to.

The split does not expire; it lasts as long as the record earns. If you would rather hold the whole thing yourself, you can buy out our half; ask and we will give you the number.

Getting it out there, and staying there

We have secured a distributor — a company whose business is supplying the stores — and the account is in place and paid for before you ask for anything. That is the part most people selling songs like this have not done, and it is why delivery to Spotify, Apple Music, YouTube Music, Amazon Music and the rest is arranged rather than hoped for. What we control is that your record arrives there correctly made, correctly credited and correctly disclosed. What we do not control is whether each service takes it. Every one of them sets its own rules about music made this way, those rules are changing, and a service that accepts a record today can change its mind about it later. Nobody in this business can honestly promise you otherwise, and we would rather you hear it from us now than work it out from a statement.

The same is true of how long it lasts. We keep it on the platforms as long as we are operating, as long as our distributor is, and as long as the platforms keep accepting music made this way. None of those three is ours to promise forever, and anybody who tells you otherwise is guessing.

Here is what we can promise. If it ever comes down — because we closed, because they closed, or because the rules changed — you already have everything you need to put it back up yourself. We do not hold it against that day and we will not have to find you years later: the master, the artwork and the metadata are yours the day it goes out.

And if a song earns nothing for two years running, we may take it down rather than keep paying to keep it there. We will tell you first, and you get the same files either way.

If you wrote the lyrics and we wrote the music, the split is the same and your name goes on the record as a writer. If you bring us a song that is already finished — your words and your music, already recorded — that is a different arrangement with different terms; ask us.

What the License Does Not Include

Copyright ownership or registration. Exclusive ownership of the underlying musical composition. The right to claim human authorship. The right to register the work with any copyright office. The right to issue takedown notices against other works.

Versions and revisions

What you receive depends on the tier you chose, and every version of it is a whole song rather than a clip. Each time we build your song you get six finished versions — six in one genre, or two each in three genres if you would rather compare directions. A Quick Song is built once. An Occasion Song is built again after you have heard it and told us to change the lyric or the style. Every Word is built three times. All of them are covered by your licence and all of them are yours to keep; we do not withhold versions or charge to unlock the one you choose. One round of changes to the lyric is included before anything is built, in every tier. Changes requested after you have chosen your final version are $50 per round and must be specific and actionable. Changing the song’s language level — cleaner or stronger — counts as a standard revision.

One thing about how these are made, said here rather than discovered later: changing a word changes the whole recording. We can get very close to a version you liked, never exactly it. That is why every version we build is yours to keep — nothing you liked is taken away because you asked for a change.

The date, and the speed

These are two different clocks and it is worth keeping them straight, because most places blur them on purpose.

The date is the promise. If your song is for something that happens on a particular day, give us that day when you order. We deliver before it or the commission is free — full refund, and you keep the song anyway. That guarantee comes with every commission, costs nothing, and is not something you can buy a better version of. If the date is too close for the option you have picked, we tell you before you pay rather than after.

The speed is the option. Standard commissions are delivered in 2–3 days. There are two speeds above that, and both are quoted to you as a date rather than a number of days, because we count working days and you should not have to guess how we count. +$50 gives your song the next working day start to finish and puts it in your hands by 5pm Eastern the day after that. +$100 puts it in your hands by 5pm Eastern tomorrow; orders for it close at 5pm Eastern, and it is not offered on a Saturday or Sunday because the next day would be a Sunday and we do not work Sundays. Rush does not buy a stronger guarantee; the guarantee is identical either way. What rush buys is the ability to order late at all. If you are ordering a week before the day, you do not need it, and we would rather say so than take the money.

The next-day option costs you your listen-back. That is not a penalty, it is arithmetic: there is no time to send the song, wait for you to live with it, and build it again. If you want to hear it and send it back, you want standard delivery, and we will tell you so.

And if we miss the hour we sold you, the fee comes back. Not the commission — the song still arrived, and if it arrived before your date the promise above was kept. But a rush fee buys a specific hour on a specific day, and if we do not hit it for reasons of our own, we did not sell you anything and we refund it without you having to ask. The exception is time that was never ours: if the lyric or an answer we needed sat with you, the hours it sat do not count against us.

Because the lyric goes to you before anything is built, a rush order has one dependency on your side: if we have not heard back on the lyric within four hours of sending it, we proceed with it as written so the hour we promised can be met. You can still request lyric changes after that, but on a rush order they are handled as a paid revision rather than the included round. The clock we guarantee is ours; we cannot guarantee time that belongs to you.

Memorial tributes

A memorial tribute is $150, the same as any commission, and is delivered in 2–3 days. You only have to go through it once: tell us about them one time and we take it from there. If you would rather stay with it and say what needs changing after you have heard it, that is there too — neither is better, and the listen-back does not expire.

The service date is required at order time, and it is treated exactly as any other date is treated above: we deliver before it, or the commission is free — full refund, and you keep the song.

Rush is available on a memorial on the same terms as any other commission — +$50 for the next working day, +$100 to have it by 5pm Eastern tomorrow. If your service is less than three days away, rush is what makes the date and the order form says so. If it is further out than that, standard delivery clears it and we say that instead rather than sell you the option.

What you have already spent here

Anything you have bought from us — a single, a record — comes off the price of a commission, dollar for dollar, up to $50 in total. It is applied to the order total, including rush, it does not expire, and whatever you do not use on one commission stays on your account for the next one.

It is counted from your own orders, so buy and commission under the same email and it is added up for you. Nothing to claim and no code to keep — sign in and the balance is there. Purchases made under a different address cannot be counted, because we have no way to know they were yours.

It is credit toward something we make, and only that. It is not cash, it has no cash value, it is not refundable, it cannot be paid out, transferred, or sold, and it cannot be redeemed for anything other than a commission. If an order carrying credit is refunded, the credit returns to your account rather than being paid to you.

Refund Policy

Once production begins, standard commissions are non-refundable, with two exceptions that we volunteer rather than bury. The first is the date guarantee above: if you gave us a date and we missed it, you are refunded in full and you keep the song, whether or not work had begun. The second is the rush fee: if you paid for a specific hour and we took longer for reasons of our own, the rush fee is returned even though the commission itself stands. Short of those two, we work with you through the revision process. Memorial tributes are covered by exactly the same two exceptions.

AI Transparency

Every song produced by MusAIc by ~MAK is AI-generated. We use machine learning models for music generation, with human production direction via the Song Architecture method. We disclose this openly and encourage our customers to do the same.
